Legal notes regarding access and use of the EDUXEDU reserved area

Please read carefully the following conditions of use since they apply to anyone accessing the reserved area. If you decide to use the reserved area you agree to comply with the following.
The service provides formation materials in electronic format (hereinafter for brevity the «Service») prepared by EDUXEDU Being Educated to Educate, a formation program for educators inspired by Chiara Lubich’s Charism of Unity.
The Service makes it possible to access and consult in an easy and effective way the materials in electronic format prepared by those in charge of EDUXEDU as part of their courses.

Information and responsibilities

The International Association New Humanity ETS (known hereafter New Humanity), based in Via Piave n.15, Grottaferrata (RM), is the owner and is responsible for the EDUXEDU project,

Profiles regarding respect for the author’s copyright

EDUXEDU is a training project that produces imaginative and creative works protected by copyright and related rights.
The materials that can be consulted through the Service are protected, where the conditions are met, by copyright law and the person responsible for the individual material is the teacher who made it available through the Service.
New Humanity reserves the right to remove or inhibit access as a precautionary measure to those materials in relation to which a dispute arises in relation to the ownership of copyright or whose legitimate use by third parties is disputed.
The information contained in the reserved area is for educational purposes and New Humanity makes every effort to provide accurate and updated information but does not assume responsibility or ensure the completeness of the information contained therein. New Humanity reserves the right to modify the information contained therein at any time and without prior notice.
Failure to comply with copyright legislation, including the right to use the EDUXEDU trademark and to reproduce and disseminate in all ways and in all languages the works created within the EDUXEDU training programme, may result in criminal and financial penalties for those responsible for the violations.

Recipients of the Service.

The Service is intended for all users who have requested it by registering in the reserved area after completing a special form. New Humanity is not liable for any direct or indirect damages resulting from access to the reserved area.
The user is to be held solely responsible for the data and information entered by him/her, for the opinions expressed in both the public and private discussion areas, and for all actions that in any way involve interaction with other users or through WordPress and Moodle platforms.

Possibility of using the materials.

Those who may view the individual materials uploaded through the Service will be authorized:
– to freely consult it, make a permanent copy in digital format (so-called download), print it on paper, for strictly and exclusively personal study and/or research purposes, with express prohibition of any direct or indirect commercial use; any other right on the material is reserved; in particular, it is not allowed the retransmission via computer network, distribution or sending in any form, including that with personal address via computer (e-mail); however, always for the same purposes mentioned above, connection is allowed by other websites through hyperlinks (so-called links) to the page of the EDUXEDU website where the material is present, as long as they are made by subjects operating for non-commercial purposes (not even indirectly) and in such a way as not to create doubts about the authorship and origin of the contents; hypertext links made with techniques aimed at preventing the recognition of (or masking the) authorship of the contents (so-called framing) are expressly forbidden.
New Humanity may include directly , at its discretion, an authorization to use the material in a completely free way or in any case wider than the one described above for an individual material.

Processing of personal data

The personal data of the Service user will be processed by the Owner New Humanity, based in Grottaferrata (RM), Via Piave n. 15, mainly in an automated way , exclusively to execute the request for registration to the reserved area and to the related Service.
As part of the procedure provided for by the Service, information and data relating to the user’s navigation will be recorded in order to allow identification and to document access to the material, in order to protect a legitimate interest of the teacher, the Owner or a third party through the availability of adequate means of proof, as well as in anonymous form for the processing of statistics on access and use of the Service.
The provision of data is optional, i.e. it does not derive from a regulatory obligation, but is mandatory in order to access the Service and failure to provide it will not allow access to the Service. Personal data will be processed by the Owner, and will not be communicated or disseminated.
The personal data collected and processed will be kept by the Owner for the period necessary for the provision of the service and in any case for the time necessary for the execution of any obligations required by law or regulation.
The user of the Service, as the interested party, enjoys the rights under EU Regulation no. 2016/679 (GDPR) and other regulations in force. In accordance with the provisions of the GDPR he/she is entitled in particular:
a) to obtain at any time confirmation as to whether or not personal data concerning you are being processed and, if so, to obtain access to the personal data and information on the categories of personal data processed, the recipients or categories of recipients to whom the personal data are or will be communicated;
(b) to request the correction of inaccurate personal data, the integration of incomplete data or the restriction of processing concerning him/her or to object to the processing of such data;
c) to lodge a complaint with the Data Protection Officer or with the competent authority of the place of habitual residence or domicile of those who contest a violation of their rights, following the procedures and indications published on the official website of the Authority on www.garanteprivacy.it;
d) to ask for the immediate deletion of personal data concerning him/her when consent is revoked, when they are no longer necessary for the purposes for which they were collected or processed, when the legal basis for processing has ceased to exist, when they have been processed unlawfully;
(e) ‘data portability’: the GDPR introduces the new right to data portability. This right allows the data subject to receive his/her personal data in a structured, commonly used and machine-readable format and – under certain conditions – to transmit them to another data controller without hindrance. Only personal data that (a) concern the data subject are portable, and (b) have been provided by the data subject; (c) the processing of which is based exclusively on a contract or the consent of the data subject; (d) the data are processed only with the aid of electronic means (paper files and manual data processing are excluded from portability).

Protection of confidentiality
If a user no longer wishes to receive correspondence and/or emails from EDUXEDU, an email or letter expressing the wish to no longer receive correspondence and/or emails may be sent to eduxedu@focolare.org

Acceptance of the Terms of Service.

The use of the Service and consultation of the relevant materials available therein presupposes full and unconditional acceptance of these conditions of use, as well as strict compliance with the further specific requirements established and relating to each individual material.

Applicable law.

This agreement shall be governed by and construed in accordance with Italian law.
